1. Acceptance of these terms
By accessing or using the Website, you agree to these Website Terms of Use. If you do not agree, you should not use the Website. These terms apply in addition to our Terms and Conditions of Sale, which separately govern the purchase of Goods; where the two conflict on a matter of Website use (as opposed to the sale of Goods), these terms take priority.
2. Intellectual property
2.1 All content on the Website — including text, layout, design, graphics, logos, and product photographs — is owned by the Company or used under licence, and is protected by copyright under the Copyright, Designs and Patents Act 1988 (“CDPA 1988”) and other intellectual property laws. “Euroboilerparts” and associated logos are trademarks of ABCOT Ltd (UK trade mark registration numbers UK00002542450 and UK00002539553).
2.2 You may view, download and print extracts of the Website for your own personal, non-commercial use, or for the genuine purpose of purchasing Goods, provided you do not modify any content and you keep all copyright and trade mark notices intact.
2.3 Except as permitted by clause 2.2, you must not copy, reproduce, republish, upload, post, transmit, distribute, frame, or otherwise use any content from the Website — including product photographs — on any other website, marketplace listing, print material, or social media, without our prior written permission. Doing so infringes our rights under CDPA 1988 s.17 (copying) and s.20 (communication to the public / making available online), and, where relevant, our trade mark rights.
2.4 To request permission to use any image or other content, or to check the copyright status of an image, contact info@euroboilerparts.co.uk.
2.5 Third-party trade marks. The Website sells both Original (OEM) parts and Compatible (aftermarket) parts. References on the Website to boiler manufacturer names and trade marks (for example Vaillant, Worcester, Baxi, Ideal, and others) are used solely to indicate that a Compatible part is intended for use with, or fits, goods bearing that trade mark, in reliance on section 11(2)(c) of the Trade Marks Act 1994. Such references do not indicate, and should not be read as indicating, that the referenced manufacturer has endorsed, approved, or is otherwise affiliated with the Company or the relevant Goods. All third-party trade marks remain the property of their respective owners.
3. Acceptable use
You must not use the Website:
- to extract, scrape, crawl, harvest or systematically download content — including product images, descriptions or pricing — by automated means, except through any API we publish or with our prior written consent;
- to attempt to circumvent any access control, rate-limiting, watermarking or other technical protection measure we apply to the Website or its content;
- in any way that infringes our intellectual property rights or those of any third party;
- to introduce viruses, malware or other harmful code, or to attempt unauthorised access to the Website, our servers, or any connected system — which may also be an offence under the Computer Misuse Act 1990;
- to send unsolicited advertising or promotional material, or to place an excessive automated load on the Website that impairs its performance for others;
- for any fraudulent or otherwise unlawful purpose.
4. Enforcement
4.1 We may suspend or block access to the Website (including at IP-address level) for anyone we reasonably believe is in breach of these terms.
4.2 Breach of clause 2 or 3 may result in us pursuing available remedies, which can include an injunction, damages, or an account of profits under CDPA 1988 ss.96–97, in addition to any other right or remedy available at law.
5. Linking to this Website
You may link to the Website's homepage, provided you do so in a way that is fair and legal and does not damage our reputation or falsely imply any association, endorsement or approval by us. You must not frame the Website within another site.
6. Third-party links
The Website may contain links to third-party websites. We have no control over, and accept no responsibility for, the content or privacy practices of those sites.
7. Accuracy and availability
While we take care to keep Website content accurate and up to date, we do not guarantee it is complete, accurate, or error-free, and we may change, suspend or withdraw all or part of the Website at any time. Nothing in this clause 7 affects the accuracy or availability obligations owed to you in respect of a completed purchase, which are governed by our Terms and Conditions of Sale.
8. Liability
8.1 To the extent permitted by law, we exclude liability for any loss or damage arising from your use of, or inability to use, the Website, or from your reliance on any content on it.
8.2 Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
9. Indemnity
You agree to indemnify us against any claim, loss or expense arising from your breach of these terms.
10. Governing law and jurisdiction
These terms are governed by the law of England and Wales. Any dispute will be dealt with by the courts of the part of the United Kingdom in which you are domiciled (England and Wales, Scotland, or Northern Ireland) or, if you are domiciled outside the United Kingdom, by the courts of England and Wales.
11. Changes to these terms
We may update these Website Terms of Use at any time by posting the revised version on this page. Continued use of the Website after a change constitutes acceptance of the revised terms.
